Terms and Conditions

All deliveries and services of Com2 GmbH products based on online orders via the internet or other online services are subject to these terms and conditions.

Deviating and/or supplementary agreements require the express consent of Com2 GmbH and must be in written form; this also applies to any waiver of the written form requirement.

If you are a known customer to us, we will process your valued order as quickly as possible, usually within 48 hours.

If you are an unknown customer, your transmission will only be considered an order if no further inquiries are necessary for the ordered items, or in the case of prepayment, the payment has been received as the payment condition.

Com2 GmbH will adhere to agreed or specified delivery times as much as possible. If these are exceeded by more than two weeks, the customer has the right to set a grace period with the indication that they will refuse acceptance of the purchased item after the deadline.

This grace period must be at least two weeks. If no agreement is reached on a new delivery date, the customer may withdraw from the contract by written declaration after the grace period expires.

SHIPPING COSTS IN SWITZERLAND: Shipping costs amount to CHF 7.00 for orders up to a value of CHF 100.00. Above this value, we deliver free of charge! Delivery times are 2 to 5 working days. If we deliver your order in several parts for technical reasons, we will of course only charge the shipping cost share once.

ORDERS FROM ABROAD: Deliveries are only carried out for customers within Switzerland.

Complaints

Complaints about transport damages must be made by the customer directly to the transport company within the specified deadlines. For shipments from the customer to Com2 GmbH, the customer bears all risks, particularly the transport risk, until the goods arrive at Com2 GmbH.

If orders sent to customers are refused, only returns to Com2 GmbH within one week from the receipt date will be accepted. The customer will be charged the incurred shipping costs plus an additional handling fee of CHF 20.00. Opened packages cannot be returned for safety reasons!

These will be fully charged to the customer along with an additional handling fee of CHF 20.00.

Invoices from Com2 GmbH are due within 30 days. Within this payment period, the customer may raise objections to the invoice in writing and with justification. After that, the invoice is considered unconditionally accepted. The customer undertakes to pay the invoiced amount without any deduction no later than the due date indicated on the invoice. If the customer does not fulfill their payment obligation within the payment period, they will be in default at the end of this period without further reminder and must pay default interest.

Com2 GmbH is entitled to charge at least CHF 15.00 per reminder. Further fees are reserved.

Complaints regarding delivery scope, material defects, incorrect deliveries, and quantity discrepancies must be made in writing without delay, but no later than within one week of receipt of the goods, provided they can be identified through reasonable inspections.

For justified complaints, Com2 GmbH will deliver missing quantities and, subject to exclusion, at their discretion exchange the goods, take them back, or grant the buyer a price reduction.

If the replacement delivery is also defective in the case of an exchange, the buyer has the right to cancel the contract or reduce the purchase price. The purchased item remains the property of Com2 GmbH until all claims to which Com2 GmbH is entitled under the contract are settled. The retention of title also applies to all claims that Com2 GmbH subsequently acquires against the buyer in connection with the purchased item, e.g., due to other services.

The customer is obliged to provide Com2 GmbH with all information required for the enforcement of rights from the agreed retention of title.

Com2 GmbH is entitled to collect, store, and process the personal data of the customer required in the context of the business relationship.

Com2 GmbH reserves the right to make product changes that serve to "improve effectiveness" without prior notice. Errors in product descriptions and prices are reserved.

The invalidity of individual points of these General Terms and Conditions does not affect the validity of the remaining provisions.

In place of the invalid provision, a new provision that comes as close as possible to the economic effect of the invalid provision shall apply.

The place of performance and jurisdiction for contracts concluded under inclusion of these General Terms and Conditions is Goldach.
